EU Digital Services Act

This page includes information relevant to the EU Digital Services Act (Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market For Digital Services and amending Directive 2000/31/EC) (‘the DSA’).

Designated Point of Contact

Pursuant to Articles 11 and 12 of the DSA, Megaport has designated DigitalServicesAct@megaport.com as the single point of contact for communications with Member State authorities, the European Commission, the European Board for Digital Services, and recipients of the service.

When sending messages to DigitalServicesAct@megaport.com please be sure to include your full name, reply email address, and the name of the EU-based authority if you are contacting us on their behalf. It is preferable that these communications are in English or German.

Transparency Reports

Megaport will publish an annual transparency report on the Megaport Documentation Portal addressing the required content as detailed in Article 15 DSA.

Government Orders from Member States

Article 15(1)(a) DSA

The number of orders received from Member States’ authorities to act against illegal content provided by recipients of the service

During the relevant period, Megaport received zero orders from EU Member States’ authorities to act against illegal content provided by recipients of the service.

The number of orders received from Member States’ authorities to provide specific information about one or more individual recipients of the service in the context of illegal content-related incidents

During the relevant period, Megaport received zero orders from EU Member States’ authorities requesting specific information about individual recipients of the service.

The time needed to inform the authority issuing the order, or any other authority specified in the order, of its receipt, and to give effect to the order.

As noted above, Megaport received zero orders from EU Member States’ authorities requesting specific information about recipients of the service during the relevant period.

Megaport’s Own-Initiative Content Moderation

Article 15(1)(c) DSA

Meaningful and comprehensible information about the content moderation engaged in at the providers’ own initiative, including the use of automated tools, the measures taken to provide training and assistance to persons in charge of content moderation.

Megaport does not generate, store, broadcast or make publicly available any content as part of our product offering. As such, we do not have content to moderate nor do we have staff carrying out content moderation.

The number and type of measures taken that affect the availability, visibility and accessibility of information provided by the recipients of the service

Megaport does not generate, host, store, broadcast or make publicly available any content as part of our product offering. As such, we do not have content to moderate nor do we take measures that affect the availability, visibility and accessibility of information provided by the recipients of the service.

The number and type of measures taken that affect the recipients’ ability to provide information through the service, and other related restrictions of the service

Megaport does not host content nor do we provide capabilities for users to share content or interact with other users on our platform. As such, during the relevant period, Megaport did not take measures that affected a recipient’s ability to provide information through the service.

Appeals

Article 15(1)(d) DSA

Number of complaints received through the internal complaint-handling systems in accordance with the provider’s terms and conditions and additionally, for providers of online platforms, in accordance with Article 20, the basis for those complaints, decisions taken in respect of those complaints, the median time needed for taking those decisions and the number of instances where those decisions were reversed.

During the relevant period, Megaport received zero appeals of the types of decisions described above.

Automated Content Detection

Article 15(1)(e) DSA

Any use made of automated means for the purpose of content moderation.

Megaport does not generate, store, broadcast or make publicly available any content as part of our product offering. As such, we do not have content to moderate nor do we have staff carrying out content moderation of any kind.
